TÉRMINOS Y CONDICIONES DE USO DE PLANTCHEMY

1. QUIÉN ES EL TITULAR
Plantchemy (en adelante, «la App») es un servicio titularidad de ROMAN SANCHEZ DE LA PARRA PEREZ, con NIF/CIF 71776876V y domicilio en 33008 Oviedo (Asturias), España (en adelante, «el Titular»). Puedes contactar en tordopollovegano@gmail.com.
2. QUÉ ES PLANTCHEMY
Plantchemy es una aplicación de recetas vegetales que incluye: una biblioteca de recetas; la conversión de recetas o platos a su versión vegetal a partir de una foto o un texto de forma automática; un laboratorio que propone recetas con los ingredientes de tu despensa; un planificador semanal de comidas y un generador de listas de la compra.
3. ACEPTACIÓN Y EDAD
Al descargar o usar la App, y de forma expresa al contratar el plan Premium, aceptas estos Términos. Debes ser mayor de edad o contar con la autorización de tu madre, padre o tutor legal y tener edad suficiente para contratar según la ley de tu país. Si no estás de acuerdo, no uses la App.
4. ACCESO SIN SUSCRIPCIÓN
Sin suscripción no puedes usar la conversión ni la biblioteca; solo verás los platos de muestra durante el tutorial inicial. Las funciones (convertir tus propias fotos y recetas, Laboratorio, planificador, lista de la compra, favoritos, carpetas, guardar recetas y el resto del recetario) requieren Premium o la prueba gratuita.
5. PLAN PREMIUM
Premium da acceso a todas las recetas de la biblioteca, a las recetas nuevas de cada semana y a las funciones automáticas con los topes mensuales descritos en el apartado 7.
• Precio: 6,99 € al mes o 49,99 € al año (equivale aproximadamente a 4,17 € al mes y supone un 40 % de descuento sobre el plan mensual). En países donde la tienda cobra en otra moneda, el precio se muestra en dólares estadounidenses u otra moneda local, con los impuestos que correspondan según Google Play.
• Prueba gratuita: si estás disponible para ella, tienes 7 días gratis al introducir tu método de pago. Durante la prueba se aplican los topes de uso del apartado 7. Si no cancelas antes de que termine la prueba, la suscripción se activa y se te cobra el plan elegido. Te enviaremos una notificación de bienvenida durante la primera hora tras suscribirte, con lo que has desbloqueado, y otra en el día 5 para recordarte que la prueba está a punto de terminar (si has permitido las notificaciones; en cualquier caso, la fecha de fin aparece en Google Play).
• Renovación automática: la suscripción se renueva automáticamente por periodos iguales (mensual o anual) hasta que la canceles.
• Cancelación: puedes cancelar en cualquier momento desde Google Play → Pagos y suscripciones → Suscripciones → Plantchemy. La cancelación evita futuros cobros y mantiene el acceso Premium hasta el final del periodo ya pagado. Desinstalar la App no cancela la suscripción.
• Pagos y reembolsos: el cobro lo gestiona Google Play. Los reembolsos se solicitan a Google conforme a sus políticas. Esto no afecta a los derechos que la ley reconozca a los consumidores.
• Contenido digital y desistimiento: al iniciar la prueba o la suscripción solicitas el acceso inmediato al contenido digital y reconoces que, una vez iniciada su prestación, puedes perder el derecho de desistimiento en la medida en que la normativa de consumidores lo permita.
• Cambios de precio: si cambiamos el precio, te lo comunicaremos con antelación suficiente y, cuando la normativa o Google Play lo exijan, solo se aplicará a partir de tu aceptación.
6. CÓMO FUNCIONAN LAS FUNCIONES AUTOMÁTICAS
Las fotos, textos y listas de ingredientes que envías para convertir una receta, generar una lista, usar el Laboratorio o traducir lo ya generado a otro idioma se procesan de forma automática con un sistema de procesamiento de un tercero. El resultado se genera automáticamente y puede contener errores, omisiones o combinaciones poco acertadas. Debes revisarlo antes de cocinar. No garantizamos que una receta resultante sea 100 % vegetal (por ejemplo, por ingredientes de marca concretos): comprueba siempre las etiquetas de los productos.
7. LÍMITES DE USO Y USO RAZONABLE
Las funciones automáticas tienen topes de uso:
• Suscripción de pago: hasta 70 conversiones de recetas o platos, hasta 60 usos del Laboratorio y hasta 30 listas de la compra al mes. Los topes se renuevan el día 1 de cada mes natural (hora UTC). Traducir al otro idioma lo que ya has generado va incluido y no cuenta como un uso aparte, con un máximo técnico de seguridad.
• Prueba gratuita de 7 días: hasta 25 conversiones, 20 usos del Laboratorio y 10 listas de la compra durante la prueba. Esos usos no se descuentan de los topes de la suscripción de pago.
Al alcanzar un tope, esa función queda en pausa hasta el siguiente periodo (o, en la prueba, hasta que empiece la suscripción de pago). Puedes seguir usando las recetas que ya tengas guardadas. Los topes pueden cambiar con el tiempo y se te informará cuando afecte de forma relevante a tu suscripción.
El plan Premium se ofrece para uso personal y razonable. Si detectamos un uso anómalo o abusivo (por ejemplo, el uso automatizado mediante programas o scripts, la reventa o el acceso con fines comerciales, compartir la cuenta con terceros, o cualquier acción que perjudique al servicio o a otros usuarios), podremos establecer un límite en tu cuenta: restringir temporalmente las funciones automáticas hasta el siguiente periodo mensual o, en casos graves o reiterados, suspender o cancelar el acceso. Las restricciones se aplican de forma proporcionada, y el acceso a las recetas que ya tengas guardadas se mantiene. Alcanzar un tope o una restricción por abuso no da derecho a reembolso del periodo en curso.
8. TU CONTENIDO
Conservas todos los derechos sobre las fotos, textos y recetas que subes o creas. Nos concedes una licencia limitada, no exclusiva y solo para el fin de procesarlos y devolverte el resultado. Declaras que tienes derecho a usar ese contenido. Si fotografías una receta de un libro, revista u otra obra protegida, hazlo únicamente para tu uso personal y privado.
9. PROPIEDAD INTELECTUAL DE LA APP
Las recetas, textos, fotografías, imágenes, el logotipo, el nombre «Plantchemy», el diseño y el software de la App pertenecen al Titular o se usan con licencia. Se te concede una licencia personal, limitada, revocable y no transferible para usar la App. Queda prohibido copiar, redistribuir, vender, extraer de forma masiva (scraping) o publicar las recetas y contenidos de la App sin autorización escrita.
10. SALUD, NUTRICIÓN Y ALERGIAS
La App tiene un fin informativo y culinario. Los valores nutricionales (calorías, proteínas, carbohidratos y grasas) son estimaciones aproximadas por ración y pueden diferir de los reales según las marcas y las cantidades. No constituyen consejo médico ni dietético. Si tienes alergias, intolerancias, una condición de salud o una dieta específica, consulta con un profesional y revisa los ingredientes (por ejemplo, frutos secos, soja o gluten). Eres responsable de la comprobación de los ingredientes y de la seguridad alimentaria al cocinar.
11. TUS DATOS Y TU DISPOSITIVO
No es necesario crear una cuenta. Tus recetas guardadas, carpetas, favoritos, listas y planificador se almacenan en tu dispositivo; si lo cambias, restableces la App o la desinstalas, podrías perderlos, ya que no hacemos copia de seguridad en la nube. Tus topes de uso mensuales se asocian a un identificador anónimo de instalación. En la Política de Privacidad se explica cómo tratamos los datos.
12. DISPONIBILIDAD Y CAMBIOS EN EL SERVICIO
Procuramos que la App esté disponible de forma continua, pero no garantizamos que funcione sin interrupciones ni errores. Podemos modificar, ampliar o retirar funciones o recetas, y cambiar los topes de uso, notificándolo cuando afecte de forma relevante a tu suscripción.
13. LIMITACIÓN DE RESPONSABILIDAD
En la medida permitida por la ley, el Titular no responde de daños indirectos ni de los derivados del uso de recetas generadas automáticamente, de los valores nutricionales estimados, de reacciones alérgicas o de interrupciones del servicio. Nada de lo aquí dispuesto limita la responsabilidad que no pueda excluirse legalmente ni los derechos que te correspondan como consumidor.
14. SUSPENSIÓN Y TERMINACIÓN
Podemos suspender o cancelar el acceso si incumples estos Términos. Puedes dejar de usar la App cuando quieras y cancelar tu suscripción según el apartado 5.
15. MODIFICACIONES DE LOS TÉRMINOS
Podemos actualizar estos Términos. Cuando el cambio sea relevante, te lo mostraremos en la App y, si afecta a tu suscripción, te pediremos que lo aceptes de nuevo. Seguir usando la App tras el aviso supone la aceptación de los cambios.
16. LEY APLICABLE Y RESOLUCIÓN DE CONFLICTOS
Estos Términos se rigen por la ley española. Si eres consumidor, se aplicarán además las normas imperativas de protección de consumidores de tu país de residencia y podrás acudir a los tribunales de tu domicilio. Para consumidores de la Unión Europea existe la plataforma de resolución de litigios en línea de la Comisión Europea (https://ec.europa.eu/consumers/odr).

PLANTCHEMY TERMS AND CONDITIONS OF USE

1. WHO WE ARE
Plantchemy (the “App”) is a service owned by ROMAN SANCHEZ DE LA PARRA PEREZ, tax ID 71776876V, with address at 33008 Oviedo (Asturias), España (the “Owner”). You can contact us at tordopollovegano@gmail.com.
2. WHAT PLANTCHEMY IS
Plantchemy is a plant-based recipe app that includes: a recipe library; the conversion of recipes or dishes into their plant-based version from a photo or text automatically; a lab that suggests recipes from the ingredients in your pantry; a weekly meal planner and a shopping list generator.
3. ACCEPTANCE AND AGE
By downloading or using the App, and expressly when you subscribe to Premium, you accept these Terms. You must be of legal age, or have the permission of a parent or legal guardian, and be old enough to enter into contracts under the law of your country. If you do not agree, do not use the App.
4. ACCESS WITHOUT A SUBSCRIPTION
Without a subscription you cannot use the conversion or the library; you only see the sample dishes during the initial tutorial. The features (converting your own photos and recipes, the Lab, the planner, the shopping list, favourites, folders, saving recipes and the rest of the library) require Premium or the free trial.
5. PREMIUM PLAN
Premium gives access to every recipe in the library, to the new recipes added each week and to the automatic features, with the monthly caps described in section 7.
• Price: US$6.99 per month or US$49.99 per year (about US$4.17 per month, a 40% discount compared with the monthly plan). Where the store charges in another currency, the price is shown in that local currency, with taxes as applied by Google Play.
• Free trial: if you are eligible, you get 7 days free once you enter a payment method. The usage caps in section 7 apply during the trial. If you do not cancel before the trial ends, the subscription starts and you are charged for the plan you chose. We will send you a welcome notification within the first hour after you subscribe, listing what you have unlocked, and another on day 5 to remind you the trial is about to end (if you have allowed notifications; in any case, the end date appears in Google Play).
• Automatic renewal: the subscription renews automatically for equal periods (monthly or yearly) until you cancel.
• Cancellation: you can cancel at any time in Google Play → Payments & subscriptions → Subscriptions → Plantchemy. Cancelling prevents future charges and keeps Premium access until the end of the period already paid. Uninstalling the App does not cancel the subscription.
• Payments and refunds: Google Play processes the payment. Refunds are requested from Google under its policies. This does not affect any rights you have as a consumer by law.
• Digital content and withdrawal: by starting the trial or subscription you request immediate access to digital content and acknowledge that, once performance has begun, you may lose your right of withdrawal to the extent consumer law allows.
• Price changes: if we change the price we will tell you in advance and, where the law or Google Play requires, it will only apply once you accept it.
6. HOW THE AUTOMATIC FEATURES WORK
The photos, texts and ingredient lists you send to convert a recipe, generate a list, use the Lab or translate what you already generated into another language are processed automatically by a third-party processing system. Results are generated automatically and may contain errors, omissions or poor combinations. You must review them before cooking. We do not guarantee that a resulting recipe is 100% plant-based (for example, because of specific branded ingredients): always check product labels.
7. USAGE CAPS AND REASONABLE USE
The automatic features have usage caps:
• Paid subscription: up to 70 recipe or dish conversions, up to 60 Lab uses and up to 30 shopping lists per month. Caps renew on the 1st of each calendar month (UTC). Translating what you have already generated into the other language is included and does not count as a separate use, subject to a technical safety maximum.
• 7-day free trial: up to 25 conversions, 20 Lab uses and 10 shopping lists during the trial. These uses are not deducted from the paid subscription caps.
When a cap is reached, that feature is paused until the next period (or, during the trial, until the paid subscription starts). You can keep using recipes you have already saved. Caps may change over time and we will tell you when this materially affects your subscription.
Premium is offered for personal, reasonable use. If we detect unusual or abusive use (for example, automated use through programs or scripts, resale or commercial access, sharing the account with third parties, or any action that harms the service or other users), we may place a limit on your account: temporarily restricting the automatic features until the next monthly period or, in serious or repeated cases, suspending or terminating access. Restrictions are applied proportionately, and access to recipes you have already saved is kept. Reaching a cap or a restriction for abuse does not entitle you to a refund for the current period.
8. YOUR CONTENT
You keep all rights to the photos, texts and recipes you upload or create. You grant us a limited, non-exclusive licence solely to process them and return the result to you. You declare that you have the right to use that content. If you photograph a recipe from a book, magazine or other protected work, do so only for your own private use.
9. INTELLECTUAL PROPERTY OF THE APP
The recipes, texts, photographs, images, logo, the name “Plantchemy”, the design and the software of the App belong to the Owner or are used under licence. You are granted a personal, limited, revocable, non-transferable licence to use the App. Copying, redistributing, selling, bulk extracting (scraping) or publishing the App’s recipes and content without written permission is prohibited.
10. HEALTH, NUTRITION AND ALLERGIES
The App is for information and cooking purposes. Nutritional values (calories, protein, carbohydrates and fat) are approximate estimates per serving and may differ from the real ones depending on brands and quantities. They are not medical or dietary advice. If you have allergies, intolerances, a health condition or a specific diet, consult a professional and check the ingredients (for example nuts, soy or gluten). You are responsible for checking ingredients and for food safety when cooking.
11. YOUR DATA AND YOUR DEVICE
No account is needed. Your saved recipes, folders, favourites, lists and planner are stored on your device; if you change phones, reset the App or uninstall it you may lose them, as we do not keep a cloud backup. Your monthly usage caps are tied to an anonymous installation identifier. The Privacy Policy explains how we handle data.
12. AVAILABILITY AND CHANGES TO THE SERVICE
We aim to keep the App available at all times but do not guarantee it will run without interruptions or errors. We may modify, extend or withdraw features or recipes, and change the usage caps, informing you when this materially affects your subscription.
13. LIMITATION OF LIABILITY
To the extent permitted by law, the Owner is not liable for indirect damages or for damages arising from the use of automatically generated recipes, estimated nutritional values, allergic reactions or service interruptions. Nothing here limits liability that cannot be excluded by law or your rights as a consumer.
14. SUSPENSION AND TERMINATION
We may suspend or terminate access if you breach these Terms. You may stop using the App at any time and cancel your subscription as described in section 5.
15. CHANGES TO THE TERMS
We may update these Terms. When a change is material we will show it in the App and, if it affects your subscription, ask you to accept it again. Continuing to use the App after notice means you accept the changes.
16. GOVERNING LAW AND DISPUTES
These Terms are governed by Spanish law. If you are a consumer, the mandatory consumer protection rules of your country of residence also apply and you may go to the courts of your place of residence. For consumers in the European Union, the European Commission’s online dispute resolution platform is available (https://ec.europa.eu/consumers/odr).
